Terms of Service

1. Agreement

By creating an account or using Elbum (the “Service”), you agree to these Terms of Service. The Service is operated by IdeaWorks ApS(“we”, “us”), a company registered in Denmark. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 16 years old to create an account. By using the Service, you confirm that you meet this requirement. Guests who upload photos without an account must have permission from the event host.

3. Your account

• You are responsible for maintaining the security of your account credentials.
• You must provide accurate information and keep it up to date.
• You may not share your account with others or create accounts for automated purposes.
• Notify us immediately at support@elbum.app if you suspect unauthorised access.

4. Acceptable use

You agree not to use the Service to:

• Upload, share, or distribute illegal content, including child sexual abuse material (CSAM)
• Upload content that violates others' intellectual property rights
• Harass, threaten, or harm other users
• Upload malware, viruses, or malicious code
• Attempt to gain unauthorised access to other accounts or events
• Use automated tools to scrape or abuse the platform
• Circumvent storage limits or technical restrictions

We reserve the right to remove content and suspend accounts that violate these rules without notice.

5. Content ownership

You own your photos. By uploading content to Elbum, you grant us a limited, non-exclusive, worldwide, royalty-free licence to store, display, and transmit that content solely for the purpose of operating the Service. We do not claim ownership of your photos, will not use them for advertising, and will not share them beyond what is necessary to provide the Service.

Guests who upload photos to an event confirm they have the right to share those photos and that the people depicted have consented where required by law.

6. Pricing & billing

• Payments are per-event, not a recurring subscription.
• Prices are in USD and exclude applicable taxes.
• Payment is processed by Stripe. We do not store card details.
• Mobile purchases are processed through Apple App Store or Google Play.

7. Refund policy

We offer a 30-day money-back guarantee on event purchases made via our website. If you are not satisfied, email support@elbum.app within 30 days of purchase and we will issue a full refund, no questions asked. Purchases made through the Apple App Store or Google Play are subject to those platforms' refund policies.

8. Storage & deletion

Photos are stored for the duration associated with your plan. When an event expires, all associated photos are permanently deleted. We will send a reminder email before deletion occurs. You can also download all photos at any time before expiry. We are not liable for any loss of photos due to expiry.

9. Account termination

You may delete your account at any time from the app settings. Upon deletion, your account data will be removed within 30 days.

We may suspend or terminate your account for violations of these Terms, illegal activity, or at our discretion with reasonable notice. In cases of serious violations (e.g., CSAM, abuse), termination is immediate without notice or refund.

10. Limitation of liability

To the maximum extent permitted by law, IdeaWorks ApS is not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of photos or data. Our total liability to you for any claim is limited to the amount you paid us in the 12 months preceding the claim. The Service is provided “as is” without warranties of any kind.

11. Governing law

These Terms are governed by Danish law. Any disputes will be resolved in the courts of Denmark, unless mandatory consumer protection laws in your country of residence provide otherwise.

12. Changes to these Terms

We may update these Terms from time to time. We will notify account holders by email of material changes at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance.
